FEDERAL AGENCY:

OFFICE OF ELEMENTARY AND SECONDARY EDUCATION, DEPARTMENT OF EDUCATION

AUTHORIZATION:

Elementary and Secondary Education Act of 1965, Title V, Part D, Section 19, as amended.
OBJECTIVES: Need help understanding this page?
To help local educational agencies (LEAs) pay for capital expenses incurred as a result of implementing alternative arrangements to provide equitable Title I services to eligible private school children, in compliance with the Aguilar v. Felton decision.

USES AND USE RESTRICTIONS:

LEAs use funds for non-instructional expenses incurred as a result of implementing alternative arrangements for providing Title I services to private-school students, including the costs of purchasing, leasing, and renovating portable classrooms and vans, and transporting private-school students to and from neutral classroom sites. This program is subject to non-supplanting requirements and must use a restricted indirect cost rate which is referenced under 34 CFR 76.564-76.569. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:   State educational agencies (SEAs). Local educational agencies (LEAs) are subgrantees.

Beneficiary Eligibility:   Children who are failing, or most at risk of failing, to meet challenging State academic standards.

APPLICATION AND AWARD PROCESS:
Pre-application Coordination:   None. This program is excluded from coverage under E.O. 12372.

Application Procedure:   SEAs apply for funds as part of Title I, Part A, State plans submitted to the Department of Education in accordance with Section 1111 of ESEA or as part of a consolidated State plan submitted under Section 14302 of ESEA. An LEA applies to its State educational agency in accordance with Section 200.16 of Title I regulations.

Award Procedure:   The Department of Education awards grants to SEAs on a formula basis. SEAs distribute funds to LEAs on the basis of need. No new awards are expected to be made under this program.

Deadlines:   Deadlines are established by each State.

Range of Approval/Disapproval Time:   Vary with each State.

Appeals:   An LEA whose application is disapproved by its SEA may appeal to the SEA and then to the Department of Education under Section 432 of the General Education Provisions Act.

Renewals:   Not applicable.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:   Funds are allocated to States based on their proportion of private school children served under Title I in the most recent school year that satisfactory data are available. There is no matching requirement.

Length and Time Phasing of Assistance:   Generally, awards to States are made from July 1 to September 30 of the following year. In addition, funds remain available to the State for an additional fiscal year for obligation and expenditure.

POST ASSISTANCE REQUIREMENTS:

Reports:   None.

Audits:   In accordance with the provisions of OMB Circular No. A- 133 (Revised, June 24, 1997), "Audits of States, Local Governments, and Nonprofit Organizations," nonfederal entities that expend financial assistance of $300,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $300,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.

Records:   In accordance with the General Education Provisions Act and the Education Department General Administrative Regulations, certain project records must be maintained for 3 years.

Obligations:   (Grants) FY 01 $6,000,000; FY 02 est $0; and FY 03 est $0. No new awards are expected to be made under this program.

Range and Average of Financial Assistance:   State award: From fiscal year 2001 funds, $91,000 to $1,053,529.

PROGRAM ACCOMPLISHMENTS:
Formula grants awarded to the 50 States, the District of Columbia, and Puerto Rico. Approximately one-fourth of LEAs serving religious school students (about 2,000 LEAs) apply to SEAs for funds.

EXAMPLES OF FUNDED PROJECTS:

Funds are used for such costs as rental of classroom space in neutral sites; rental or purchase of mobile vans; and transportation of private school students to public schools or neutral sites.
