AUTHORIZATION:
Energy Policy and Conservation Act, Title III, Sections
361-366, Part C, Public Law 94-163, 42 U.S.C. 6321-6326; Department of Energy
Organization Act of 1977, as amended, Title VI, Section 621, Public Law 95-91,
42 U.S.C. 7101; National Energy Conservation Policy Act of 1978, Public Law
95-619, Public Law 101-440; Balanced Budget Down Payment Act II of 1996,
Public Law 104-134.
To promote the conservation of energy and reduce the
rate of growth of energy demand by authorizing Department of Energy (DOE) to
establish procedures and guidelines for the development and implementation of
specific State energy conservation programs; and to provide Federal financial
and technical assistance to States in support of such programs.
TYPES OF ASSISTANCE:

USES AND USE RESTRICTIONS:
Grants are to be used by States in the development,
implementation, or modification of State plans submitted to and approved by
DOE. To be eligible for Federal assistance, each State plan must contain the
five program activities required by the Energy Policy and Conservation Act,
Public Law 94-163; and may also include a wide range of optional activities.
Funds cannot be used for the purchase of land, buildings or any interest
therein; construction of buildings or structures; research, development or
demonstration of non-commercially available technology; or subsidies of public
transportation, fares, utility rate demonstrations or State tax credits for
energy conservation.
ELIGIBILITY REQUIREMENTS:
Applicant Eligibility: All
States plus the District of Columbia, the U.S. Virgin Islands, Puerto Rico,
Guam, Samoa, and the Commonwealth of the Northern Mariana Islands.
Beneficiary Eligibility:
The ultimate potential beneficiaries will be the people affected by the plan
each State develops. This is anticipated to be the State's population.
Credentials/Documentation:
Only one application from each State; compliance with State and local
environmental statutes and regulations. Costs will be determined in accordance
with 10 CFR Part 600 for State and local governments.
Pre-application Coordination:
The standard application forms as furnished by the Federal agency and required
by CFR Part 600 must be used for this program. Administrative requirements
will be determined in accordance with CFR Part 600. No pre-application form is
required by DOE. No informal pre-application conference is needed or
recommended. Consultation and assistance will be available from DOE in the
preparation of the application. This program is eligible for coverage under
E.O. 12372, "Intergovernmental Review of Federal Programs." An
applicant should consult the office or official designated as the single point
of contact in his or her State for more information on the process the State
requires to be followed in applying for assistance, if the State has selected
the program for review.
Application Procedure:
States submit applications and plans (or amendment to plans) in response to 10
CFR 420.
Award Procedure: Grants
will be awarded incorporating State proposals.
Deadlines: Submission date
is announced annually by DOE and depends on when the availability of funds
becomes known.
Range of Approval/Disapproval Time:
DOE attempts to review and approve applications within two months of receipt.
Appeals: As designated in
10 CFR 420.
Renewals: Continuing grants
subject to Congressional appropriation.
ASSISTANCE CONSIDERATIONS:
Formula and Matching Requirements:
Grant allocations for State Energy Program appropriations up to $25.5 million
is based on a formula reflecting and incorporating the historical allocation
of funding for the two major Programs the State Energy Conservation Program
and the Institutional Conservation Program, allocation of funding for
appropriations in excess of $25.5 million is based on the following factors:
33 1/3 percent divided equally among states; 33 1/3 percent divided on the
basis of the population of the participating states; and 33 1/3 divided on the
basis of the energy consumption of the participating States.
Length and Time Phasing of Assistance:
Funds awarded annually subject to Congressional appropriation, with no
restriction on spending period. Funds released through the Electronic Transfer
System. Annual budget periods are set by each grantee within parameters
established by DOE.
POST ASSISTANCE REQUIREMENTS:
Reports: Standard 10 CFR 600
reporting and auditing requirements and DOE specific reports cleared with OMB
must be submitted.
Audits: In accordance with
the provisions of OMB Circular No. A- 102. In accordance with the provisions
of OMB Circular No. A-133, (Revised, June 24, 1997), "Audits of States,
Local Governments, and Non- Profit Organizations," nonfederal entities
that expend financial assistance of $300,000 or more in Federal awards will
have a single or a program-specific audit conducted for that year. Nonfederal
entities that expend less than $300,000 a year in Federal awards are exempt
from Federal audit requirements that year, except as noted in Circular No. A-
133.

development and implementation of their State plans.
