AUTHORIZATION:

Civil Rights Act of 1964, Title VII, 42 U.S.C. 2000(e), as amended; Executive Order 11246, September 24, 1965; Reorganization Plan No. 1, 1978.
OBJECTIVES: Need help understanding this page?
To enforce Federal laws providing equal employment opportunities for all without regard to race, religion, national origin, and sex, and to defend the lawfulness and constitutionality of Federally authorized affirmative action programs.

USES AND USE RESTRICTIONS:

Title VII of the 1964 Civil Rights Act, as amended, and other Federal Laws and regulations forbid discrimination by employers, labor organizations, employment agencies, State and local government and public agencies. The Attorney General is authorized to sue to enjoin and remedy discrimination in employment by State and local government agencies. Upon referral from the Department of Labor, the Attorney General is authorized to sue to enforce the non- discrimination in employment provisions of Executive Order 11246, as amended, with respect to government contractors and subcontractors. The Attorney General does not, as such, represent specific individuals, though the public interest is served by obtaining relief for them through pattern or practice or 706 referral lawsuits. In addition, the Civil Rights Division represents other Federal agencies in challenges to laws and orders that authorize affirmative action in employment, procurement and contracting on federally-assisted projects.

PROGRAM ACCOMPLISHMENTS:
(Employment Litigation Section) In fiscal year 2001, the Employment Litigation Section filed eight Title VII complaints, settled three Title VII cases, obtained one out-of-court settlement of a Title VII charge, obtained 27 out-of-court settlements with school districts that had failed to file State and Local Government Reports EEO-5, and continued to increase its outreach efforts.
