USES AND USE RESTRICTIONS:

Funds are provided to State agencies to cover administrative costs incurred at the State and local level in the operation of the program.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:   States which enter into agreements with private or public non-profit organizations that provide food assistance to the needy are eligible.

Beneficiary Eligibility:   Public or private non-profit organizations which provide food assistance to the needy.

Credentials/Documentation:   Costs will be determined in accordance with OMB Circular No. A-87 for State and local governments.

APPLICATION AND AWARD PROCESS:
Pre-application Coordination:   This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to be followed in applying for assistance, if the State has selected the program for review.

Application Procedure:   Not necessary; all States are eligible to participate. However, this program is subject to the provisions of OMB Circular No. A-102, as implemented by 7 CFR part 3016. This program is excluded from coverage under OMB Circular No. A-110.

Award Procedure:   Cash assistance is allocated among the States on the basis of poverty level households (60 percent) and of unemployed persons (40 percent). At a minimum, States must make 40 percent of the administrative grant available to local agencies or expend such funds on their behalf.

Deadlines:   None.

Range of Approval/Disapproval Time:   As required; 60 days or more.

Appeals:   None.

Renewals:   Not applicable.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:   Funds for administration of the program are allocated by formula to States. Sixty percent of the formula is based on the people below the poverty level and 40 percent on the number of unemployed. In FY 2002, $50 million will be available Nationally for TEFAP administration.

Length and Time Phasing of Assistance:   Funds are provided through the electronic transfer system as they are needed for actual expenditures on a fiscal year basis. Any funds which are made available through the initial allocation or a subsequent reallocation that are not used are turned back to the Federal government.

POST ASSISTANCE REQUIREMENTS:

Reports:   Quarterly and annual financial reports are made on FCS- 667.

Audits:   In accordance with the provisions of OMB circular No. A- 133, "Audits of States, Local Governments, and Non-profit Organizations," State and local governments and non-profit organizations that expend Federal financial assistance of $300,000 or more within any fiscal year shall have either a single audit or (in certain cases) a program specific audit made for that year. Audits may be conducted less frequently under conditions specified in A-133.

Records:   Normal records accounting for receipts and dispersals; retention required for 3 years.

PROGRAM ACCOMPLISHMENTS:
Provided funds to State and local agencies to process, store, and distribute USDA and private-donated commodities to needy persons and to organizations for use in preparing meals at congregate meal sites.
